GENERAL INFORMATION. TERMS AND CONDITIONS – MAY 2022
BOAT SALES – All boat sales must be notified via marina office to prevent any unauthorised persons on the moorings. If a boat is sold from the marina it does not necessarily retain its existing or any mooring.
BOAT SAFETY – Fire extinguishers are advised on board, please ensure these are within date period and serviced as necessary.
At least one manual bilge pump for emergency use. It is advisable that your craft has a current Boat Safety Scheme Certificate. We recommend a spare key is lodged with the office as you will be liable for any damage caused should we have to obtain entry. You may also forget your keys!
INSURANCE – The owner is to insure their own craft and contents therein against all risks including (but not limited to) third party claims. The company and its employees accept no responsibility for any loss, damage or theft of craft or vehicles or any articles left thereon or therein, or any accessories thereof, or the property of the owner, other than solely through its own negligence.
TOILETS – A chemical toilet disposal point is situated behind toilet building. Pump-out facility available by appointment (cost as price list).
GENERAL SERVICES AVAILABLE – Docking by arrangement, prices quoted through office. Electricity is available on meter at dock side area. Calor Gas, diesel, miscellaneous fuels, lock windlasses etc., are available through the office.
GENERAL TERMS & CONDITIONS
– Forms of identification required, passport, driving license, utility bill.
– It is the duty of all craft owners to provide Hallingbury Marina with an up-to-date contact address and telephone numbers.
– No guarantee is given or responsibility accepted by the company for the suitability of any berth, gear, equipment or other facility.
– All persons using any part of our premises, including jetties and stagings, for whatever purpose, and whether by invitation or not, do so at
their own risk. Whilst the Company does not accept responsibility for access jetties where these exist, tenants are advised to keep these
scrubbed to avoid possibility of slipping.
– All works that are not D.I.Y. must be notified through the office. Any outside firms or contractors being employed to carry out work to any
boats must supply us with proof of adequate insurance cover before being permitted access to any part of the marina. All such works must
be carried out with due respect to the premises, boats and authorised users of the marina. In the event that any works are carried out without
adequate insurance the craft owner will be held responsible for any damage caused. We recommend that any heavy or messy work is carried
out at the dockside area by prior arrangement with the office or at facilities outside the marina.
– Although every care will be taken, no responsibility will be accepted for damage to cars and boats caused by flying objects whilst grass
cutting is in progress.
– Parking for one vehicle per craft within the marina. No visitor or secondary vehicles are permitted within marina areas. Tenants to display
parking permit (supplied by office) in prominent position on dashboard of vehicle. The limited parking outside the marina is solely for the
use of visitors and can be subject to clamping. No parking alongside boats. Please notify office of long stay parking.
– To avoid refusal of entry, all visitors to obtain authorisation before entering the marina and to be accompanied by boat owner.
– Please place food waste only in bins provided.
– Gates to be kept closed and locked at all times.
– Any articles or obstructions left on paths, banks, access jetties, hedges etc., will be removed & disposed of.
– Swimming is not permitted.
– Any dinghies, canoes etc., to be kept on parent vessel and not to be used in the marina.
– The company reserves the right to move any boat in the interest of safety or expediency and in certain circumstances to alternative moorings
temporarily or permanently.
– Tenant to supply and fit name plates to bow and stern of boat.
– Maximum speed limit of 5mph along Old Mill Lane and all access roads and marina tracks.
– Maximum speed of 4 knots on Stort Navigation and dead slow in the marina.
– All dogs to be kept on lead and under control at all times, and owners to clear any fouling.
– No generators to be run within marina areas.
– Any noise, including music or radio, to be kept to a minimum so as not to cause nuisance.
– No tents, camping or campervans permitted.
– No fishing in the marina or back stream from 15th March to 15th June. All fishing regulations to be adhered to and relevant licences obtained.
– Water supplies to mooring areas should be used for filling your boat water tank only and are turned off during the winter months.
– No craft to be used for residential, business or any form of trading purposes. Marina and/or vessel not to be used as a primary residence.
– All boats are to be used solely for the pleasure and recreation of the boat owner.
– We will not accept the delivery of anyone’s personal mail, any such items will be returned to sender.
– At the end of the Agreement you will remove the boat at your own cost or else you will settle on demand any expense we incur in removing
the boat should you fail to do so.
– All re-rendered accounts overdue over fourteen days will be surcharged at 4% over bank rate.
– We reserve the right to a lien upon owners craft/gear (to cover any outstanding account or sums due to us) and we reserve the right after
giving notice of our intention and after a reasonable time (not less than 2 months) from such notice to sell any such craft/gear by public
auction or otherwise at our discretion to settle any amounts due to us and thereafter surplus funds (if any) after monies due and costs of sale
would be forwarded to you.
– You are to meet all service/rates charges and assessments now or at any time in the future assessed upon you or any occupier or user of the
boat or the moorings and you will keep us fully indemnified in relation to any such.
– The foregoing terms of business clause etc., shall be deemed part of any quotation. Acceptance of which shall imply acceptance of the whole
of these conditions.
– Two month’s (60 days) notice required for termination of tenancy.
– We reserve the right to terminate tenancy.
– For the purpose of the above clauses the expression owner or tenant will include a charterer, master or authorised agent.
– Our inclusive wifi service is aimed for light content usage only (eg emailing and accessing low volume website data). Usage of the Wireless Connectivity Services (WCS) is for lawful purposes only, and in a manner which does not infringe the rights of, or restrict or inhibit use or enjoyment of the WCS by any other persons. The WCS must not be used in a way that is unlawful or fraudulent; or to deliver, knowingly receive, upload, download, use or re-use any information or material which is abusive, defamatory, obscene or menacing, or in breach of any copyright, privacy or any other rights; or to send or to promote the sending of any unsolicited advertising or promotional material; or in a way which infringes any third party’s Intellectual Property Rights; or in a way that does not comply with any written or electronic instructions sent by us to you. You shall be responsible for any losses, expenses or other costs incurred by us that are caused by your breach of the aforementioned clauses. We shall notify you of any such claims or proceedings and inform you regularly as to the progress of such claims or proceedings. You acknowledge that we will not be responsible for any sites, goods or services offered or made available via the WCS provided by third parties. You acknowledge that we will not be responsible for the content of the chat areas. By entering these areas, you and your sub-account holders accept this, and agree to waive any claims against us for any distress, injury, loss, liability, damage and expense arising from or in connection with your use of these areas or their contents and you will indemnify us against any claims arising from your and your sub-account holders’ use of these areas or any content of the areas which you post or create. You must ensure that your password(s) used in connection with the WCS are kept confidential and are only used by authorised users. You accept and acknowledge that the WCS are used at your own risk and you accept responsibility for protecting your PC/Laptop/Device from any unauthorised access by means of firewalls or other methods. We cannot guarantee that the WCS will be fault-free or above a particular speed and will hold no liability for any losses related to you or your business activities, such as loss of data, security breaches, loss of profits, business interruption, etc.
